CLAIM CONTROL CLAUSE The Assurers, shall have the option of naming the attorneys who shall represent the Assured in the prosecution or defence of any litigation or negotiations between the Assured and third parties concerning any claim covered by this policy, and shall have the direction of such ligitation or negotiations. If the Assured shall fail or refuse to settle any claim as authorized by this company, the liability of this company shall be limited to the amount for which settlement could have been made plus legal fees and disbursements incurred to the date the Assured shall fail or refuse to settle any such claim, less the amount of the deductible provided for in this policy. If thereafter any amount is recovered against the Assured in excess of the amount, plus additional legal fees and disbursements for which the claim could have been settled , such additional amount plus legal fees and disbursements shall be solely for the Assured's account.
