1. SUBJECT EC delivers helicopters and/or spares to civil customers with release documents issued by or on behalf of their national Authority, i.e. DGAC member of the JAAs. These documents are issued within the Production Organisation Approval (POA) held by the manufacturer. The acceptance and delivery of the products usually takes place within the EC sites. They may be delocalized in a subsidiary part of the EC Group, providing the extension of the EC POA to the subsidiary, as defined in this document.
2. PROCESS DESCRIPTION The process to extend the EC POA to a subsidiary includes the following steps: 2.1
Industrial agreement
An industrial agreement is set up between EC and the subsidiary in order : • to define the requirements to be observed and the responsibilities of each party. The quality requirements are those specified in EN 9000 standard complemented by requirements specific to the project • to identify by name the staff belonging to the subsidiary who will be authorised by EC and under their responsibility to certify the statements of conformity (JAA FORM 52) for aircraft or the authorised release certificate (JAA FORM 1) for spares. 2.2
Access to Data The subsidiary receives or has access to the EC and Authority data to determine the compliance and airworthiness of the products and/or spares, including as appropriate: • for aircraft : design data, manufacturing file, inspection file, flight testing documents, customer support documents, design standard required for type certification, modification approval data, • for spare parts : shelf life requirements, interchangeability, DGAC approval, airworthiness data, • DGAC Airworthiness Directives.

Qualification of the Subsidiary EC checks the subsidiary's ability to perform the activities that are necessary to establish the compliance and airworthiness of the helicopters and spares. Authorisation of the certifying staff A protocol is to be signed between EC and the staff belonging to the subsidiary, authorised by EC and under their responsibility to certify the statements of conformity for aircraft or the authorised release certificate for spares. This protocol defines the obligations of the certifying staff in regards to meeting the requirements specified by EC.

Agreement between Authorities An agreement is to be signed between the subsidiary's National authority (NAA) and the manufacturer Authority (DGAC) to define the tasks and responsibilities of each Authority : production monitoring, modalities for the issuance of the Certificate of Airworthiness signed by DGAC, handling of problems, etc.

DGAC Approval to extend the EC POA The extension of the EC POA to a subsidiary must be approved by DGAC beforehand.
3. GENERAL ORGANIZATION The EC Quality Directorate is responsible for maintaining the production organisation approval. It ensures that the POA extension is in compliance with JAR 21/G requirements, and that the quality system procedures are updated accordingly. The EC Quality Directorate audits the operations in the subsidiary and the EC concerned areas to ensure the compliance with JAR 21/G and with the procedures supporting EC Production organisation approval. The concerned EC Business Centre is responsible for the certificates of compliance signed by the subsidiary personnel authorised by EC. It is responsible for providing the subsidiary with the data and the assistance to conduct the required operations and inspections. This includes the assistance in processing non conformities.

4. RULES R1 The subsidiary is operating under EC control and in compliance with EC requirements R2 The subsidiary's Quality System is qualified and monitored by EC R3 The personnel performing and certifying the production, ground testing, inspection and flight testing operations is qualified by EC
R4 The certifying staff signing the JAA FORM 52 and JAA FORM 1 documents is formally authorised by EC.
R5 The certifying staff signing the JAA FORM 52 and JAA FORM 1 commits the responsibility of EC, as the POA holder, in addition to their own individual responsibility.
R6 The design of the helicopters and/or spares released within the framework of EC POA is approved by DGAC. This includes the optional installations as well as the concessions and repairs raised further to production defects.
R7 The working documents and application data used by the subsidiary are either the original EC documents and data or those issued by the subsidiary and accepted as equivalent by EC
R8 The subsidiary informs EC of the major defects encountered in production and the flight incidents that need to be processed by EC Major Incidents Commission.
R9 The components, parts and appliances, procured by the subsidiary for helicopter assembly and/or delivery of spares under EC POA are delivered to the subsidiary under EC technical control with delivery documents signed by or on behalf of EC, or according to a procedure approved by EC.
