“CAUDALIE 1 DAY 1 GIFT 2017” INSTAGRAM COMPETITION RULES 1 - CAUDALIE (hereinafter referred to as “the Organiser”), a company with a capital of €1,011,800, registered in the Commercial Register of Paris under number 398 360 123 and whose registered office is located at 6 Place de Narvik, 75008 Paris, France, is organising a free competition with no purchase necessary to enter. 2 – This competition, with no entrance fee and no obligation to make a purchase, will run from 12 noon (French time) on 1st December 2017 to 11.59 pm (French time) on 25 December 2017. It is open to all individuals aged 18 and over residing in Germany, Belgium, Brazil, Canada, the United Arab Emirates, Spain, the United States, Metropolitan France (Corsica included), Hong Kong, Iran, Italy, Luxembourg, Mexico, Portugal, the United Kingdom and Switzerland, with the exception of people having a direct or indirect legal relationship with the Organiser. 3 – To take part in the competition and for the chance to win the prizes being offered, the participant must visit the Organiser’s Instagram account, at the URL address https://www.instagram.com/caudalie/. Each day, a post will invite the participant to answer a question by leaving a comment. The Participant may take part as many times as they wish throughout the duration of the competition, with only one participation permitted per day. Any incomplete or unidentifiable participation, whether intentional or not, or entry via any other form from that outlined in these terms and conditions, shall be deemed null and void. Any attempt to take part using multiple email addresses or from an account opened in somebody else's name shall be excluded. The value of the prize is €150,00 including VAT. The value of the prize is determined at the time of writing these rules and may not be challenged with regards to their evaluation. This prize cannot, under any circumstances, be exchanged for cash, other goods or services, or more generally any form of financial compensation. 5 – One winner will be selected by the CAUDALIE jury the day after each Instagram post is made, from the comments giving the correct answer.

6 – The winners will be notified by a private message via Instagram within 15 calendar days of the selection of the winner. On this occasion, the Organiser will ask the winner to communicate her/his contact information (last name, first name, full postal address). The contacted winners will have 7 calendar days to communicate her/his contact details. After this period, the Organiser may designate a new winner. 7 – The prize, if awarded, will be sent free of charge by post to the winner within 6 weeks of the Organiser receiving her/his postal address. 8 - In accordance with the “Data Protection” Act No. 78-17 of 4 January 1978, amended, participants have the right to access, correct, object to and remove personal data by sending a copy of a valid identity document and legibly stating the purpose of their request to the Organiser of the competition: CAUDALIE

9 - By entering this competition, an entrant is indicating his/her agreement to be bound by these terms and conditions. 10 – These rules are governed by French law. Any dispute falls within the jurisdiction of the courts of the Appeal Court of Paris.

11 - The complete terms and conditions are filed with SELARL Franck CHERKI and Virginia RIGOT, a private professional limited liability firm of registered legal bailiffs domiciled at 119 Avenue de Flandre, 75019 Paris. The competition rules are available free-of-charge on written request. 12 – Telephone communication costs, corresponding to the connection time when participating in the competition, are redeemable by any participant who makes a written request to the Customer Relations Department CAUDALIE 6 place de Narvik – 75008 PARIS within a month of disbursement of these expenses (date attested by the postmark) by enclosing their bank details, and within two months of receipt of the participant's request. Reimbursement by the Organiser carries a flat rate for an internet connection time of 10 minutes per day, subject to providing supporting information with dates, times and durations of the connections to the website. Postage costs of the request for reimbursement of connection costs will be reimbursed at the rate in force and on request. Only one reimbursement of costs (connection and postage) can be made per household (same name, same address, same e-mail address). Access made on a free or as part of a package basis (e.g. ADSL) shall not give rise to any reimbursement since connection to the site does not incur any additional costs for the participant.

13 - The Organiser reserves the right to shorten, extend, modify or cancel the competition if circumstances so require and accepts no liability in this regard or any claim for compensation by participants. Furthermore, the Organiser disclaims any liability for the occurrence of events presenting the characteristics of force majeure or unforeseeable circumstances that are beyond its control, depriving participants of the opportunity to participate in the competition and/or winners to benefit from their prizes. In no case may the Organiser be held liable for any incidents that may occur during the use of the prizes by the winners once they have taken possession of them. Any additional cost required for taking possession of the prizes is the sole responsibility of the winners, with the latter being unable to claim any financial compensation from the Organiser. It is understood that the Competition is in no way organised with the assistance of Instagram and that the latter shall not be accountable to the Participants.

14 - The Organiser reminds participants of the characteristics and limitations of the Internet and accepts no liability for the consequences of their connection to https://www.instagram.com/caudalie/. In particular, the Organiser may under no circumstances be held liable in the event of problems regarding delivery or loss of mail or e-mail. Moreover, the Organiser shall not be liable for any material or immaterial damage caused to participants, their computer equipment and the data stored on it and the possible implications this may have on their personal or professional activities. Neither may the Organiser be held liable should one or more participants be unable to connect to https://www.instagram.com/caudalie/ or take part in the competition due to a technical fault or any problem relating to network congestion.

15 - The Organiser reserves the right to change the prizes. These changes, however, will be made known by all appropriate means. The new prizes will be of equal value to the prizes mentioned in paragraph 4.

16 - In accordance with the laws governing the rights of Literary and Artistic Property, or related rights, reproduction and representation of all or part of the contest component elements, is strictly prohibited. 17 - The winner authorises in advance, in whatever capacity, the Organiser to use his/her last name, first name, postal or internet address for promotional or advertising purposes on any medium, without restriction or reservation and without this giving rise to any entitlement to remuneration or any kind of advantage other than the allocation set out in Article 4 of these rules. Subject to their explicit consent, the information gathered about the participants may be used by the Organiser and/or its partners to better serve and inform them about their new products and offers that may be of interest to them.
