In the absence of Mr. DURDENEVSKY (USSR), Chairman of ,the joint subcommitt e.....of • . W JC ad been studying the question of the emoluments: of the judges of the International Court of Justices, the Chairman asked Mr. HAMBRO (Chief of Section) to introduce the report of the joint subcommittee (document A/C.6/24). Mr. HAMBRO summarized the decisions of the joint subcommittee as follows: (1) The Preparatory Commission bad recommended that the value of the emoluments of the judges of the International Court of Justice should be not less than that of the judges of the Permanent Court of International Justice during the period 1936 to 1939. The subcommittee recommended that those salaries should be increased by 20 per cent to allow for the higher cost of living in The Hague since 1939.

HAMBRO resume ainsi les decisions de la sous-eommission mixte : ' (1) La Commission preparatoire recommande que la valeur des emoluments des juges de la Cour internationale de justice ne soit pas inferieure a celle des emoluments qui recevaient les juges de la Cour permanente de justice internationale au cours. de la p&iode 1936 a. 1939. . (2) The allowances would remain the same as the allowances paid to the President and VicePresidents of the Permanent Court of International Justice. (3) The allowances for judges ad hoc should be increased by 20 per cent, from 100 to 120 florins per diem. The CHAIRMAN put this part of the report of the subcommittee referring to salaries to the vote. Decision : The Committee adopted the recommendations of the subcommittee unanimously.. The OIAIlUlAN then asked the Committee for their observations on the second part of the report of the subcommittee which contained a' reenmendation to be submitted to the ~neral Assembly regarding the development of a pension plan for the judges and the registrar.

2. Recommendation to the General Assembly to authorise the Secretary-General to take the necessary steps to convene the International

Court ollustice (A/C.6/22) The CHAIRMAN asked the Rapporteur of the Committee, Mr. READ (Canada) to introduce the recommendation to the General Assembly to instruct .the Secretary-General to take all the necessary steps to convene the International ~ourt of Justice as soon as possible after the electlOn of the judges of the Court. Mr. READ outlined the contents of the recommendation and stated that, since the Committee had had the document for several days, it was not .necessary to elaborate the subject. Decision: The Committee adopted the recom· . mendation unanimously.

3. Recommendation concerning the registration of treaties and international agreements (A/C.

6/22) Mr. READ (Canada) as Rapporteur of the Committee, presented his report on the question of registration. of treaties and international agreements. He stated that in the drafting he had taken into account the objections expressed at the last meeting of the Committee by the delegate for Panama and others, to an invitation being sent to the Government of Franco Spain to send in their treaties for filing and publication and in the report he had used the wording of the Potsdam Agreement when referring to Spain. -

M. READ (Canada) Rapporteur de la. Commission presente son rapport relatif a l'enregistrement des traites et accords internationaux et il declare qu'll a tenu compte en le redigeant des objections qui ont ete formul~es A la derniere seance de la Commission par les deIegues du Panama et d'autres pays concernant l'invitation au Gouvemement espagnol de Franco d'envoyer ses traites aux fins de classement et de publication. Dans son rapport, il s'est servi des termes de I'Accord de Potsdam chaque fois qu'i! a tte fait mention de l'Espagne.

Mr. ~ORETSKY .(Ukrainian SSR) proposed that, while he appreclated the reference to Spain in the preamble to the recommendation, the word .. peace-loving" should be inserted before .. nonMember States" since the expression was used in . article 4 of the Charter; and he felt that the United Nations should not address communications to nations which were not" peace-loving."

Mr. PORRAS (Panama) congratulated the Rapporteur on the manner in which he had dealt with the subject. He opposed the amendment of . the delegate for Ukraine since he felt that Franco ..might con~ider .Sp~ as the most peace-loving of all the nahons smce lt had not been involved in the war. He ~ropo.sed to substitute for paragraph (d) the fo~oWUlg! smce he felt that a specific reference to the mtenhons of the Committee was necessary:

Mr. SPIROPOULOS (Greece), after thanking Mr. Porms for his explanation, stated that he was opposed to the amendment of the delegate for Ukraine, for the same reasons expressed by the .delegate for South Africa. He suggested redrafting the last paragraph SO that the SecretaryGeneral should be authorized to register and publish any treaties and international agreements sent in by non-Members. .

Sir John BARTLEY (India) also wished to avoid any specific reference to any particular government, and proposed the inclusion in the last paragraph of the recommendation " unless such invitation is to be deferred until authorized by the General Assembly," in order that the wishes of the Committee expressed in the preamble should not be overlooked.

Sir Hartley SHAWCROSS (United Kingdom) proposed that in order to avoid the difficulty confronting the Secretary-General in sending out invitations to governments which were not acceptable to the Members of the United Nations, the Legal Committee should recommend that the General Assembly should authorize the SecretaryGeneral to receive for filing and publication any treaties sent in by non-l\fembe~ States and not to invite them to do so.
