Le Ballon Bleu - General Conditions for individual balloon flights - 2018 P urchase of tickets T ick ets can be purchased by phone, postal m ail, e-m ail or direct at the following address: Le B allon B leu, 63390 S auret-B esserve. Tick ets will be sent to the custom er by m ail im m ediately after the com pleted order form has been received and paym ent has been m ade in full. T he conditions have been been contracted by the buyer, but the tickets can be transferred to any other person within the original validity period, provided this has been agreed upon with Le Ballon B leu. In any case the holder of the ticket is considered to have accepted these general conditions, without any exception or reserve. A ll tickets are valid at least 12 (twelve) m onths from the date of purchase, to cover a full ballooning season (from 1 A pril to 30 O ctober). The validity period is m entioned on the ticket. The tickets are valid for balloon flights taking off in the geographical area of the C om brailles, Auvergne, France. T he ticket holder m ust m ake him - or herself physically available for at least two (2) confirm ed flight attem pts during the original validity period of the ticket and the usual ballooning season (between 1 April and 30 O ctober). If the ticket holder does not m ake him /herself available for at least two flight attem pts during the validity period, the ticket wil autom atically expire at the end of the validity period without any restitution. If the flight attem pts m ust be cancelled due to bad weather conditions, the validity of the ticket will be extended to cover another season, without any additional costs. After two years an extended tick et will expire definitively. It is the responsability of the ticket holder to contact Le Ballon B leu in order to organize a flight and set a date; if and when Le Ballon B leu takes the initiative to contact ticket holders, this is considered an additional service but im plies no obligation to do so. Tickets are not reim bursable O ur tick ets are not reim bursable. C lients who reserve a flight for 2 people along with a stay in our gîte/studio pay a reservation fee instead of buying a pre-paid tick et and this will be reim bursed in case of bad weather during their stay of at least a week (7 days). T hey will have to m ak e them selves available for a flight at any tim e during that period to be reim bursed in case all flight attem pts are cancelled. The balance of the cost of their flight is to be paid on the day of the flight. Fixed date reservation fee In case of a fixed date reservation, the reservation fee is non reim bursable. H owever, the client can use the reservation fee as a down paym ent for the purchase of a full standard ticket at any m om ent within a year of the reserved date. The ticket in question will then be valid a year from the date of its purchase. R ates/prices O ur rates and ticket prices m entioned on our web site and in our brochures, posters etc. are indicative and m ay be changed. T he actual tick et price will be com m unicated to the client at the tim e of purchase. All our consum er rates include TV A (B T W /V A T ) where applicable. C onditions for flight Le B allon B leu is held to the conditions of the W arsaw C onvention and E uropean and French regulations concerning aerial activities and transport of passengers. A ccording to air law , the pilot is the m aster on board and has authority on all persons on board the aircraft. H e/she has the authority to refuse access to any person who or any object which m ay present a danger to the safety of the flight or the order on board. H ealth, age and w eight Le B allon B leu is not com petent to judge the physical condition of any flight participant. Every passenger m ust ensure that he or she does not suffer from any m edical condition incom patible with a balloon flight, if neccessary by consulting their doctor. P assengers m ust be able to enter (clim b into) the basket under their ow n pow er, rem ain upright in the basket w ithout seats or other support for the duration of the flight and absorb an im pact com parable to a jum p from the second step of an average stairw ay (about 30 cm s). O ur basket is not equipped to transport people suffering reduced m obility. Le Ballon B leu strongly advises any passenger who has recently been the subject of surgery to consult their doctor before deciding on a flight. Pregnant wom en m ay not fly in our balloon(s). Children younger than the age of twelve (12) years m ay not fly. It is the responsibility of the parent or legal representative to com m unicate the age of a m inor to be em barked. T he load calculations for balloons are based upon an average weight per passenger of 75 kilogram s. A flight m ay be cancelled when the true total passenger weight exceeds the load lim its for the prevailing conditions (especially tem perature, expected flight altitude and m inim um fuel load for the expected flight trajectory). Flight conditions A balloon flight is entirely dependant on the weather. O nly the pilot is authorized to decide whether or not to take off. Le B allon B leu reserves the right to cancel a flight due to weather conditions (including tem perature relative to the actual take-off m ass of the balloon) up to the m om ent of take-off for safety reasons. In no case will Le Ballon B leu be liable for any costs incurred by clients due to a flight cancellation. A s the flight is entirely dependant on the weather, Le Ballon B leu does not guarantee any trajectory. The average duration of a flight is around one hour plus or m inus 15 m inutes. T he pilot has the right to m odify/adapt the flight duration, the take-off site, the flight planning and generally everything concerning the flight. Insurance T he price of the tickets includes the costs of third-party liability insurance covering each passenger for am ounts according to European regulations concerning the transport of passengers. Valuables carried by our passengers are not included in the coverage, and neither are the costs of dam age to clothing as a result of the flight and other activities related to the flight (transport, baptizing cerem ony...). T he insurance does not cover suicide or voluntary injury. T he insurance is valid from the beginning of inflation/launch preparations to final deflation of the balloon after landing. Passengers are advised to ensure they have accident insurance that covers flying in a balloon as a passenger. Flight confirm ation W e ask passengers to contact Le Ballon B leu by phone within 24 hours before the planned flight to confirm , around 21:00 hours the evening before a planned m orning flight at the latest. W eather conditions and the likelihood of a safe flight will then be discussed and the final planning presented. C ancellation by the client If a passenger cancels their flight within 72 hours before a reserved or planned flight, or if the passenger does not show up for the planned rendezvous on the day of the flight, the ticket (or the reservation fee) is considered to have been used and will expire. The client can cancel and reschedule a flight up to 72 hours before the planned flight date and tim e without penalty. C lothing; safety (French and EU air law ) S m oking is legally prohibited on board and in the vicinity of the balloon. Passengers m ust follow the instructions of the pilot. Passengers are not allowed to leave the basket without authorization of the pilot, even after landing. W e strongly advise passenge rs to wear solid protective shoes or boots and clothing m ade from non-synthetic fibers. C lothing should com pletely cover arm s and legs. P hotography M any people take m any photos during balloon flights, preparations and after-flight festivities. In som e areas and countries, authorities m ay prohibit publication of aerial im ages of 'sensitive' or 'strategic' locations; it is up to the photographer to ensure publication rights for such im ages tak en during a flight in our balloon. U nless otherwise agreed, photos taken of the balloon, from out of the balloon during flight and of the related activities (such as inflating, packing up, the baptism cerem ony and the traditional cham pagne toast) by us, our crew m em bers and by our passengers m ay be used by Le B allon B leu for prom otional purposes on our websites and in print. P assengers m ay always have photos portraying them rem oved from our site(s) if they deem them im proper. Acceptance of the G eneral C onditions A ny reservation and actual boarding by passengers autom atically im plies full acceptance of these general conditions.
