INTRODUCTION
Welcome to our new ‘off the peg’ Wine List, a snapshot of the drinking wines that we have available in stock. It is designed to complement both our hard copy, en primeur releases of wines from great Domaines (see calendar p.11) and our website. The website is aimed at introducing new customers via the ‘Shop’ section to more affordable, ready-todrink wines that are chosen with precisely the same care as our ‘Big Guns’. In addition and as a result of your feedback, the ‘Cellar’ section of the site will offer significantly upgraded Fine Wine trading functionality later this year. Keep abreast of these exciting developments on www.corneyandbarrow.com. Central to our buying strategy is the sourcing of wines that are exclusive to Corney & Barrow and therefore to you and that these should attempt to be the best value and the best in their category. The success we have had is the result of focusing on both supplier and customer relationships simultaneously, not least through a vastly increased number of tastings, masterclasses and dinners. A programme of these events may be found on p.23. They remain central to the intensely personal nature of our business and the one-to-one relationship with you that we believe in so strongly.
From the North of England to the East of Asia is a big step, but in both areas we have opened larger offices (see contacts p.8) to meet the demands of a significantly wider audience. In all this development, the values that you demand of us remain constant – the belief in integrity, independence of thought and action and above all the importance of personal relationships. It is these that have taken Corney & Barrow into another record year. As always, we rely on you to let us know how we can further develop the business to your benefit.
ADAM BRETT - SMITH APRIL 2 0 1 1
Please do have a look at the following pages, which outline our approach and all the services that we can now offer, not least a new, nationwide, dedicated delivery service in our own liveried vans.

OUR COMPANY
...Based on Relationships From winemaker, to the office, through to delivery, our service is a personal one.
Our relationships with our producers are based on the same principles as our relationships with our customers; they are with people, are personal and based on mutual trust. From Domaine de la Romanée-Conti to our House Wine supplier, our relationships with our producers are exclusive and individual. We bring wine directly from the Châteaux or Domaine, offering you wines with unrivalled provenance and advantageous opening prices.
Our roots are in selecting and selling wine from the traditional wine growing areas, principally France. We continue to admire this tradition, and seek out these classic style and quality cues throughout the wine world. We also have strong relationships with other leading independent wine merchants; together we have formed an organisation called The Bunch. For more information see our website www.corneyandbarrow.com.
We can offer you access to first-hand knowledge and experience; we hold regular events with the winemakers to put a personality to the wines and spread their remarkable knowledge and skill, directly; undiluted (see p.23). We offer our wines in the following ways, direct from the producer, to ensure sound provenance: • Young wines to drink now • Wines released en primeur (i.e. pre-bottling) • Parcels of older vintages • Broked wines, most of which have been bought from our customers and therefore have come direct from the producer

EN PRIMEUR RELEASES
Buying wine en primeur While this list is primarily concerned with wines ‘Off the Peg’ (i.e. in stock and ready to go), a very important part of what Corney & Barrow offers is en primeur.
En primeur refers to a long-established practice, originally associated with the purchase of young Bordeaux wine. Wines bought en primeur have not yet been bottled and are still in the cask. Historically the main reason for buying en primeur was to buy at a better price than that which you might pay when the wine is bottled and shipped to the UK. However, there are other key advantages: it allows you to secure an allocation of potentially rare, highly sought-after wines, which may be produced in very small quantities. You may specify the bottling format you would like; halves, magnums or larger formats etc. It also guarantees the absolute best provenance of your wines, direct from the châteaux. For more information, or talk to a member of our team, call 020 7265 2430.

Buying and Selling Our Broking Team is both a significant buyer and seller of well-cellared, mature fine wines. h o w t o s e l l yo u r w i n e We offer both broking and outright purchase terms, depending on market conditions. • If you choose to broke your wines, we list your wines and on completion of the sale we pay you the agreed selling price less 10%. You therefore receive 90% of the selling price. • An outright purchase typically means you receive the selling price less 20%. In both cases, for wines that are not stored with Corney & Barrow, we offer a free collection service and insurance from any address in the UK mainland. We also offer free valuations.
We are particularly keen to buy full cases of classified growth Bordeaux and Burgundy, in addition to wines for which we are exclusive agents for the primary market: b o r d e au x Châteaux Pétrus Trotanoy Latour à Pomerol La Grave à Pomerol Magdelaine Tertre Roteboeuf La Fleur-Pétrus Hosanna burgundy Domaine de la Romanée-Conti Clos de Tart Domaine Comte Georges de Vogüé Domaine Bonneau du Martray Domaine Leflaive i ta ly Giacomo Conterno s pa i n Pingus and Flor de Pingus c h a m pa g n e Salon If you are interested in selling, please contact Paul Marus, Chris Howles or Rachel Donnelly by email at

Build Your Cellar W h at i s t h e C o r n e y & B a r r o w C e l l a r C lu b ? The Cellar Club is an easy, no-fuss way of building up a selection of wines for the present and for the future. We offer a bespoke service to create a collection of wines around your tastes and needs – whether it is classic clarets, elegant white Burgundies, boutique northern Italian producers or a more eclectic mix of wines from the world over. These wines can be bought to keep or to drink; the Cellar Club can provide you with a steady supply of great value drinking wines for immediate consumption. Simply tell us the styles of wine you enjoy and we will send you a regular delivery. T h e B e n e f i t s o f S ta r t i n g a Collection Everything about wine is supposed to be enjoyed and savoured in a leisurely and relaxed manner. Many of the world’s fine wines need a certain time after bottling to mature, develop and gain in complexity and depth and for the tannins and acidity to soften. Think of the Cellar Club as taking care of the maturation process of your wines and delivering them to you in perfect readiness to be enjoyed and savoured. K e y B e n e f i t s o f t h e C e l l a r C lu b • Access to some of the world’s finest wines. • Evenly distributed cost of building your cellar. • Cellaring facility if needed, with competitive storage rates. • A selection of wine to keep or drink. • Personal service, to match your specific requirements. • No administrative charges – 100% goes on building and maintaining your cellar.
14
H o w d o e s i t wo r k ? The Cellar Club operates around an easy-to-manage standing order, from as little as £100 a month. You can choose how much you would like this to be. On joining the Cellar Club, you will be appointed a dedicated representative who will help build your cellar with you. During an initial consultation, he or she will get to know your likes and dislikes and help to shape a cellar of wines to perfectly suit your requirements. You can set up your Cellar Club membership so that our experts make the wine selection for you, or you can do so yourself. You will be contacted by your Cellar Club representative at intervals agreed at your initial consultation, for updates on purchases or recommendations. Wines are purchased from the credit in your account, but the Cellar Club allows you to reserve wines with a value of up to three times the amount of your monthly subscription. If you wish to make additional purchases, then you can of course do so. You do not need a cellar/storage facility of your own. We have a very close partnership with Cert Octavian who runs a unique underground cellar where your wine will be in safe hands until we advise you of its optimum drinking window. When you decide you want to drink the wine, whether it is shortly after purchase or in 10 years’ time, we can arrange to have it shipped directly to your door.
Join the Cellar Club and we will give you a case of Château Barrail du Blanc Grand Cru, St-Emilion 2009 to start your cellar.
Membership Term The minimum membership term is 12 months. M o n t h ly S u b s c r i p t i o n The minimum monthly subscription is £100. R e s e r vat i o n Fa c i l i t y Cellar Club members may reserve wine from time to time, provided that the value of wine reserved at any time (taking into account monthly subscriptions received) may not exceed three times the amount of their monthly subscription. Purchases in excess of this limit must be paid for at the time of order. Wine that has been reserved by a Cellar Club member does not pass to that member until Corney & Barrow has received payment in full settlement of that member’s account for that wine. S to r ag e For the prevailing rates, please see p.16. Storage charges can either be settled from the monthly subscription, or in accordance with the standard terms. Storage charges will not be levied on wines that have been reserved but not yet paid for. D e l i v e ry Delivery in mainland UK of one 9 litre case equivalent or more is free of charge. STORING YOUR WINE
‘ P rov e na n c e ’ a n d o u r S to r ag e Fac i l i t i e s The conditions in which your wine is stored are absolutely critical both in terms of you being able to drink it in the best possible condition and maximising its value should you ever decide to sell. Provenance of wine is now one of the biggest influencing factors when customers are choosing to buy wine on the secondary market and we are seeing clear evidence of a preparedness to pay higher prices for the finest stock. We would urge you, therefore, to keep your wines in store if you think you may sell them at a later date. We have two cellaring facilities: Octavian’s Corsham Cellars in Wiltshire and our own bonded cellars in Ayr where some of our Scottish customers have their reserves stored. We believe that these facilities are amongst the finest in Europe. C o r s h a m C e l l a r s , W i lt s h i r e Octavian’s cellars at Corsham are situated 100 feet below ground level in the Wiltshire hills. Originally a mine for the distinctive Bath stone, this cavernous space measures one million square feet. In 1934 it was taken over by the MOD: its qualities deemed perfect for the storage of munitions. This led to the installation of an omnipresent duct system, which is still instrumental today in promoting air circulation for the cellar. It was bought by Cert Octavian in 1989, who, after extensive investment, opened Corsham Cellars as a fine wine storage facility. It is now the world’s leading cellaring facility. C o r n e y & B a r r o w C e l l a r s , Ay r In 1994, Corney & Barrow’s Scottish operation merged with Whighams of Ayr, one of the longestestablished wine merchants in the UK. Set up by a group of prominent Ayrshire merchants and landowners, Whighams traditionally supplied fine wines and spirits to many of the great houses and estates in southern Scotland. The large cellars were purpose built below the shop in 1766. Over the centuries, these cellars have been steeped in history; it is indeed highly likely that the local resident Customs Officer, a young Mr Robert Burns, would have been a regular visitor. The cellars were built for the sole purpose of storing imported wines, ports and sherries shipped on the company-built vessels, which plied their trade around Europe. They remain in perfect condition for wine storage today.

S t o r i n g w i n e s t h at a r e n o t purchased from us On rare occasions, customers request that wines purchased elsewhere be cellared with us. We are happy to accommodate such requests but please note that we levy a charge of £7.50 per case ex VAT to cover the administrative costs of booking the wines onto our system. Thereafter, our usual storage charges will be levied on these wines. Please note that we cannot be held responsible for the quality of these wines due to their unknown provenance. Delivery from reserves is free of charge to your home address. Deliveries to multiple addresses will be charged at the prevailing rate. Due diligence In the past, the Wine Trade has suffered a number of well-documented fraudulent movements of customers’ reserve stocks. We are absolutely committed to ensuring that our customers and Corney & Barrow do not fall foul of such incidents. To this end, we would like to remind customers that we will only accept written instruction from the account holder (emails and faxes are acceptable) when being asked to handle any movements of wines held in reserve. For accounts held in joint names, we will accept, rely and act upon instructions given by any one of the customers named on that account unless previously expressed to the contrary. We are unable to accept instructions for the movement of reserves over the telephone. We apologise for any inconvenience that this may cause, but we are equally sure that you will appreciate the reason behind it.
Provenance of wine is now one of the biggest influencing factors when customers are choosing to buy wine on the secondary market...

There are a number of wines in our drinking portfolio which we think of as our ‘benchmark wines’ – these are perhaps the second or third wines of well-known Domaines, that have benefitted from all the expertise of the top wine makers, but without the price tag. Alternatively, they are wines, such as Achaval-Ferrer, that we feel is the benchmark for its region and style. We hope you enjoy the case as much as we do.

BIG BOTTLES . SMALL BOTTLES
What better way of making a meal special than a big bottle? Whether it is an imperial for a one-off dinner party or simply a magnum over family lunch, large formats lend a sense of occasion to any table. At the other end of the spectrum, half bottles let you open something delicious on a week night without having to worry about leaving it open overnight. They are also a great way of trying new wines – think of them as large samples!

The Corney & Barrow Company Reserve, our exclusive label blend, has been selected and blended by the team at Ets. CORNEY & BARROW ’ S OWN
One of our hottest tips: the production of three of our house wines, all from the Right Bank, is overseen by the same team responsible for Châteaux Trotanoy, Magdelaine and Hosanna, amongst others. These are our great friends at Etablissements J-P Moueix, a hugely respected company whether wearing their négociant hat or that of prestigious property owners. Their quality stamp shows through at every level, from the very top end where we have to allocate wines, through to our good old Company Reserve. Corney & Barrow Company Reserve is a Merlot dominated blend offers excellent value – classic claret from a great year. Likewise, Corney & Barrow Saint-Emilion and Pomerol provide wines which are both true to their origins and bear the hallmark Ets. J-P Moueix quality, flair and value for money. Our Corney & Barrow House Claret, another faithful friend, is blended by the Corney & Barrow buying team with the help of Maison Sichel’s oenologist Ivan. For a white wine option, Corney & Barrow House White is a perennial favourite inhouse. Sourced from our very long-standing suppliers Plaimont, in Gascony, South-West France and blended by our buying team, it punches well above its weight – deliciously refreshing and highly recommended.

CHAMPAGNE DELAMOTTE Champagne Delamotte, founded in 1760, is one of the oldest houses in Champagne, and one of its most discreet. Based in Le Mesnil-sur-Oger, the grand cru village celebrated for its Chardonnay-based champagnes, Delamotte is well-known by insiders for its stylistic finesse and precision. Sister-house of ultra-rare Champagne Salon, Champagne Delamotte’s pedigree is second to none. The Blanc de Blancs NV, Grand Cru Le Mesnil is poised and fine; it may be non-vintage but its filigree structure and light creamy texture are extremely elegant and it offers great value for money. Etablissements Jean-Pierre Moueix founded a wine merchant business in 1937 in Libourne, Bordeaux, working exclusively with the wines of the Right Bank with particular concentration on Pomerol and St-Emilion. In the 1950s, Jean-Pierre grew the business to include purchases of several well-known properties, notably Châteaux Magdelaine and Trotanoy. They are now responsible for the distribution of many of the great wines of St-Emilion and Pomerol including, of course, the fabled Château Pétrus. Currently moving into its third generation with Jean-Pierre’s son (Christian) and grandson (Edouard) at the helm, Ets. Jean-Pierre Moueix’s role as wine merchants is as strong as ever. They also act as négociants, dealing wine on the Bordeaux marketplace, including the classed growth properties of the “Left bank”.
L’Hospi ta l et de G a zi n, Pom e rol 20 07 Pomerol from a prime site, adjacent to Pétrus. This, the second wine of Château Gazin, is rigorously selected, to ensure top quality. Designed to be accessible in youth, Hospitalet de Gazin presents ripe cherries and plum fruit, delicately spiced.
Ch At e au Ba r r a i l du Bl a nc , Sa i n t-E m i l ion Gr a n d Cru 20 07 Deep ruby colour. Barrail’s light, sandy soil favoured the conditions in 2007 and offers a treacly ripe fruited nose, a supple, easy and seductive palate, a gently chewy structure and a pleasantly long finish. A firm favourite of Corney & Barrow and customers alike. W i l l H a rg rov e , Pr i vat e S a l e s M a n ag e r

OL I V I ER LEFLA I VE Over the last three years working at C&B, I have recommended Olivier’s wines countless times. I’ve served them to friends at home, at three extremely enjoyable dinners with Olivier and his talented winemaker, Frank Grux and (once) to Royalty at a grand dinner. Yes, you could say I am a fan! The Bourgogne Blanc Les Sétilles is, year in year out, my benchmark white Burgundy – I’ve not tasted anything else at this price which can match its exceptional consistency, balance and finesse. As you taste up the portfolio you’ll find great quality at every level. I adore his wines from Rully, Pernand, Saint-Aubin and Puligny. Olivier owns some of the finest terroir in the Côte d’Or and has gained the reputation as one of Burgundy’s most respected wine producers. His wines will never let you down. TENUTA DI BISERNO The new estate of legendary producer Lodovico Antinori. These sumptuous Tuscans, built around the Cabernet Franc grape and other Bordeaux varietals, are destined for greatness. Situated in coastal, western Tuscany, amongst the hills of Bibbona, cooled by sea breezes.
I l Pi no di Bise r no 20 07 Violets and ripe cherries, notes of coffee and spice, with a silky texture. With or without food, this is an elegant wine for all occasions. G u y S e dd o n , Pr i vat e S a l e s

TENUTA DI Pa s sopisci a ro Andrea Franchetti has always risen to his own, extreme challenges; the hallmarks of a true legend. Tenuta di Passopisciaro, his estate in Eastern Sicily, is no exception. The vineyards are situated on the extra-ordinary Northern slopes of Mount Etna, a live volcano, at 1,000 metres above sea level. The majority of his planting was from cuttings from old Nerello Mascalese vines, a native Sicilian variety which, when grown in these extreme mineral soils, provide a unique sense of place. The Passopisciaro looks like a Pinot Noir, but don’t be fooled. Fairly light yet structured with a freshness driving the pure red fruits and deep mineral layers; age can bring delightfully complex savoury and smoky notes. J oe M u l l e r , Pr i vat e S a l e s

2011 — PETER LATEST SISSECK VINTAGE RELEASED EN PRIMEUR
W I NES OF PETER SISSECK Peter Sisseck arrived in the Ribera del Duero and sought out parcels of ancient vines on perfectly exposed terroir. The result was ‘Pingus’ – a trailblazer which had the world at its feet from the outset. Since then he has created a smaller wine from vineyards across the Ribera, Psi (a play on his initials). Despite the 2008 being only our second vintage, it is already a firm favourite; vibrant, fresh and pure – Tempranillo at its best. Supple and sweet wild berry fruit with a fine mineral backbone. It is modestly priced and enjoyable in its youth but would benefit enormously from some short term cellaring. Graha m M o ss, P r i vate S al e s

HYDE DE V I LLA I NE The first Hyde de Villaine wines were released in 2010, to great excitement. This is a new venture in California between the renowned de Villaine family from Burgundy and the Californian Hydes. The Hyde de Villaine vineyard produces two Chardonnays, a Syrah and a Merlot / Cabernet Sauvignon blend. All the wines show real balance, poise and elegance. The cooler conditions found in the Carneros region give the wines great freshness as well. HdV Syrah, Hyde de Villaine 2006 has a deep plum appearance with delicately spiced rich cassis fruit. This has the classic Syrah pepperiness but a much smoother and more delicate finish. E d P i l k i n g t o n , P r i vat e S ales

ACHAVAL -FERRER In 1998, a group of Italian and Argentinian friends joined forces to realise a then extremely ambitious dream – the creation of world class Argentinian wine... and that is what they did. The 2009 Malbec, whilst still quite youthful, has wonderful spicy fruit on the nose with distinctive tamarind flavours. On the palate the fruit is sweet and ripe with very elegant tannins and excellent length. Delicious now, this will age well over the next five to six years. A fabulous example of top quality Malbec. M a l bec Ach ava l F e r r e r 20 0 9 A bit of a benchmark Argentinian wine for me. I love it for its perfumed aromas, for its bright vivid tang and for being more of a ballerina than a boxer. It’s lithe and powerful but not brutish; an elegant Malbec that never fails to impress. Olly S m i th, T h e M ai l on S un day, Fe brua ry 2 0 1 1

ese terms and conditions (“Terms and Conditions”) apply to and form Th part of every contract between Corney & Barrow Limited (“Corney & Barrow”) and its customers (“Customer”). No terms and/or conditions which the Customer may seek to impose shall apply or have effect. 1. D E FINITI O N S In these Terms and Conditions: “Goods” means the products or services to be supplied by Corney & Barrow to the Customer; “Private Customer” means a Customer who is not a Trade Customer; and “Trade Customer” means a Customer who purchases Goods with a view to resale in the ordinary course of its business and/or who Corney & Barrow notifies is classified as such. 2. P R I C E S A N D PAYM E NT T E R M S 2.1 Corney & Barrow reserves the right to require payment for Goods at the time of order. 2.2 In all cases where invoices are issued then (unless Corney & Barrow agrees other payment terms): (a) invoices to Private Customers must be paid within 30 days after the invoice date; and (b) invoices to Trade Customers must be paid on or before the 21st day of the month following the month in which the invoice date falls. 2.3 All prices are quoted in pounds sterling. Any applicable VAT, duty and delivery charges will be added at the time of order or, in the case of Customer reserves held in bond, when the relevant reserves are delivered or collected. 2.4 For Customers outside the UK, payment must (unless made at the time of order) be received prior to shipment of the relevant Goods or within 30 days after the date of invoice, whichever is the earlier. Customers outside the UK who arrange their own delivery are responsible for the payment of any applicable VAT and duty (or their equivalent) in the country of delivery. 2.5 Payment can be made by major credit or debit card, cheque, direct debit or by direct electronic transfer (bank details available on request). Corney & Barrow may refuse to accept cash settlement of amounts due and will always refuse cash sums in excess of £5,000. 2.6 Any increase in freight charges, duty, tax and/or changes in rates of exchange following payment will be passed on to the Customer if shipping and/or clearance from bond have not occurred prior to such increases. Similarly, if duties are reduced before shipping and/or clearance from bond, any reductions will be credited to the Customer. 2.7 If any amount remains unpaid after the due date for payment, then Corney & Barrow reserves the right to do any or all of the following: (a) charge interest at 2% per month on any amount remaining unpaid after the due date, calculated from the due date until the actual date of payment; (b) review and/or remove retrospectively any special trading terms previously agreed in relation to the transaction(s) to which those overdue accounts relate (including discounts, in which case Corney & Barrow may re-invoice the Goods at their full price); (c) require payment of all other unpaid amounts invoiced to the Customer (whether or not then due and payable); and/or (d) suspend any future deliveries to the Customer. 2.8 Corney & Barrow reserves the right to charge an administration fee of not less than £15.00 for each cheque unpaid by the Customer’s bank, including cheques which are returned marked “Please represent”, and an administration fee of not less than £15.00 for each unpaid direct debit. 2.9 All payments to be made by the Customer shall be made in full, without any deduction, withholding, set-off or counterclaim. 2.10 In no circumstances will we be obliged to proceed with your purchase of wine at an incorrect price, even if we have accepted your order for wines displayed at the incorrect price and/or failed to inform you of the error. 3. D E L I V E RY 3.1 Delivery within mainland UK is free of charge for orders with a value in excess of the prevailing minimum amount. All other deliveries, including those overseas, are charged at the prevailing rate plus VAT (where applicable). 3.2 Delivery within mainland UK will normally be made within 7 working days after acceptance by Corney & Barrow of the Customer’s order. Delivery outside mainland UK will normally be made within 14 to 21 working days after acceptance by Corney & Barrow of the Customer’s order. 3.3 Notwithstanding acceptance by Corney & Barrow of any order, all Goods are offered for sale subject to availability. 3.4 Delivery of recent vintages lying in stock outside the UK will be delayed until the Goods are shipped into the UK. Shipment into the UK in these circumstances will be made at the earliest suitable date. Delivery of broking stock will not take place until Corney & Barrow has taken possession of the relevant stock. 4. TIT L E IN G O O D S 4.1 Until such time as Corney & Barrow receives payment in full (in cash or cleared funds) for all Goods that Corney & Barrow has at any time supplied to the Customer, the Goods shall remain the property of Corney & Barrow. 4.2 Until ownership of the Goods has passed to the Customer: (a) the Customer shall store the Goods separately from other goods of the Customer and/or keep them in such a way (at no cost to Corney & Barrow) that they can be readily identified as being the property of Corney & Barrow; (b) the Customer shall hold the Goods on a fiduciary basis as Corney & Barrow’s bailee;
72
(c) the Customer shall not destroy, deface or obscure any identifying mark on or relating to the Goods; and (d) the Customer shall maintain the Goods in satisfactory condition and keep them insured on behalf of Corney & Barrow for their full replacement value against all risks. 4.3 Until ownership of the Goods has passed to the Customer, the Customer may resell the Goods in the ordinary course of business at full market value on the basis that the Customer has no authority to enter into any contract of sale on Corney & Barrow’s behalf, but does so as principal and the net proceeds of any sale are the property of Corney & Barrow. 4.4 Without prejudice to any other remedy that Corney & Barrow may have, Corney & Barrow may, at any time, revoke the Customer’s power of sale under paragraph 4.3 by notice to the Customer if the Customer is in default in payment of any sum whatsoever due to Corney & Barrow, or if any cheque (or other negotiable instrument) drawn by the Customer in favour of Corney & Barrow is dishonoured on presentation for payment, or if Corney & Barrow has bona fide doubt as to the solvency of the Customer. 4.5 The Customer’s power of sale under paragraph 4.3 and its right of possession of the Goods shall automatically cease if the Customer (being an individual) has a bankruptcy order made against him or makes an arrangement or composition with his creditors, or otherwise takes the benefit of any statutory provision in force from time to time for the relief of insolvent debtors, or (being a body corporate) is being wound-up or enters into a company voluntary arrangement (within the meaning of Part 1 Insolvency Act 1986) or is placed into administration, administrative receivership or voluntary liquidation or a receiver is appointed over any of its assets or the Customer enters into any other insolvency proceedings governed by the provisions of the Insolvency Act 1986 and/or the Law of Property Act 1925 (in each case as consolidated, re-enacted, modified or replaced from time to time) or any analogous insolvency proceedings in any other applicable jurisdiction. 4.6 Upon the revocation of the Customer’s power of sale under paragraph 4.3 by Corney & Barrow or its automatic cessation, all amounts payable in respect of all Goods supplied shall become due immediately whether or not such amounts are then due and payable. 4.7 The Customer grants Corney & Barrow, its agents and employees an irrevocable licence at any time to enter any premises of the Customer, or to which the Customer has access, for the purpose of inspecting the Goods or, where the Customer’s right to possession has terminated, to recover any Goods. 4.8 The rights of Corney & Barrow set out in this paragraph 4 shall remain in full force and effect notwithstanding termination of the relevant contract with the Customer. 4.9 Corney & Barrow may maintain an action for the purchase price of the Goods notwithstanding that ownership of them has not passed to the Customer. 4.10 In the case of Goods purchased ‘En Primeur’, these Goods may be stored in bulk in the region of their production. Until the Goods are bottled and transferred to Corney & Barrow’s bonded warehouse, they cannot be segregated and the Customer may have a contractual rather than a proprietary interest in them. 5. R E TU R N S , B R E A K AG E S A N D N O N - D E L I V E RY 5.1 If any wine purchased from Corney & Barrow fails, for any reason, to give satisfaction, Corney & Barrow will replace, or issue a credit for, that wine provided that the wine is returned to Corney & Barrow within one month after the earlier of (a) the invoice date for the wine and (b) the date of payment for the wine. Corney & Barrow is not obliged under this guarantee to deliver any replacement wine to an address outside the United Kingdom. 5.2 Customers who have purchased wine ‘En Primeur’ have the right to change their mind in respect of, and be issued a credit for, that wine provided that they notify Corney & Barrow in writing within one month after the earlier of (a) the invoice date for the wine and (b) the date of payment for the wine (in each case, In Bond UK). 5.3 Corney & Barrow offers a “sale or return” service for parties within its London van delivery area and within its Scotland van delivery area. Corney & Barrow will arrange for unopened cases to be returned to its warehouse following which a credit note will be raised. Corney & Barrow reserves the right to refuse to accept the return of Goods, or to credit the value of any returned Goods, which are not in a saleable condition. 5.4 Claims for breakages will only be allowed if the Customer notifies Corney & Barrow as soon as possible (and, in any event, within 7 days) after delivery. The Customer must retain breakages and accompanying packaging for examination by Corney & Barrow or its agent. 6. R E S E RV E S T O R AG E 6.1 Corney & Barrow offers storage facilities to its Customers for Goods purchased from Corney & Barrow or (in accordance with paragraph 6.6) from other sources. 6.2 Storage charges shall be at the prevailing rate plus VAT (where applicable) per year (or part year) per case. Charges will be rendered annually in arrears or when the reserves are delivered or collected and are to be paid by direct debit or as otherwise agreed with Corney & Barrow. For accounts opened after 1st June 2004, annual storage charges will be collected by direct debit as a condition of storage being provided. Corney & Barrow’s storage rental year runs from 1st June to 31st May. A list of reserves will be sent to the Customer annually in June with an invoice for storage for the year ending on the immediately preceding 31st May. 6.3 Reserves can only be made and withdrawn in multiples of one case. 6.4 If Corney & Barrow is requested to move reserves within its warehouse, e.g. from a bonded area to a duty paid area, there will be a handling fee charged at the prevailing rate.
6.5 Reserves will be insured by Corney & Barrow against all risks of physical loss or damage as at the date of such loss or damage subject to the policy terms or conditions. Although it is Corney & Barrow’s intention to cover the present market value of any losses, in view of the difficulty in assessing the total market value and the market value of individual rarities, Corney & Barrow can only try to ensure that full compensation is recovered in cases of loss. 6.6 As an additional service, Corney & Barrow can offer storage for Goods purchased from other sources. In addition to the standard storage charge, there is a booking-in fee, which will be charged at the prevailing rate. It is the Customer’s responsibility to authenticate these Goods upon arrival at Corney & Barrow’s premises. Corney & Barrow will not accept liability for either the provenance or condition of Goods purchased from other sources or for any defect or other fault that these Goods may have or may develop. 6.7 Corney & Barrow may require any Customer instructions to deal with reserves to be confirmed in writing before acting on those instructions. 7. L I E N In the event of non-payment of accounts (including storage charges), Corney & Barrow reserves the right to exercise a lien over and/or to sell some or all of a Customer’s reserves and to deduct from the proceeds of sale any outstanding amounts. 8. L IMITATI O N S O F L I A BI L ITY 8.1 Nothing in these Terms and Conditions shall exclude or limit in any way Corney & Barrow’s liability for death or personal injury or for fraudulent misrepresentation or for breach of its obligations under s12 Sale of Goods Act 1979 or s2 Supply of Goods and Services Act 1982 or s2(3) Consumer Protection Act 1987. 8.2 Corney & Barrow shall not be liable to the Customer for ullages or for any deterioration in the condition of any wine (which can occur naturally to all wines no matter how well cared for), whether that wine is in reserve storage with Corney & Barrow or stored separately by or on behalf of the Customer. 8.3 Corney & Barrow shall not be liable to the Customer for any claim (whether arising in or for contract, tort (including negligence), breach of statutory duty, misrepresentation or otherwise) under or in connection with these Terms and Conditions for: (a) any loss of profit, revenue, anticipated savings, business or contract; and (b) any special, indirect or consequential loss. 8.4 Corney & Barrow’s total liability arising under these Terms and Conditions shall not in respect of any single claim exceed the order value including any VAT, duty and delivery charges of the order that gives rise to the claim. 9. W E B S IT E S A L E S 9.1 Purchases may be made via our website (www.corneyandbarrow. com). Use of our website is subject to our Website Terms and Conditions, which can be found on the website. 9.2 All purchases made via our website must be paid for by credit or debit card at the time of order. 10. G E N E R A L 10.1 In the UK, it is illegal to sell alcohol to anyone under the age of 18 years. Similar restrictions apply in other jurisdictions. By placing an order with Corney & Barrow, the Customer confirms that he or she is at least 18 years old (or otherwise above any applicable age limit). At the time of delivery of the Customer’s order, Corney & Barrow or its agent may request proof of age from the person accepting the delivery. If appropriate proof cannot be produced, Corney & Barrow or its agent may refuse to deliver the order. 10.2 C orney & Barrow may amend these Terms and Conditions from time to time. None of Corney & Barrow’s employees or agents has the right to bind Corney & Barrow to any verbal agreement which does not comply with these Terms and Conditions. 10.3 C orney & Barrow shall not be liable for any failure to meet its obligations caused by circumstances beyond its control. 10.4 No provision of these Terms and Conditions shall be enforceable pursuant to the Contracts (Rights of Third Parties) Act 1999. 10.5 No delay in exercising or non-exercise by Corney & Barrow of any right, power or remedy under or in connection with these Terms and Conditions shall impair that right, power or remedy or operate as a waiver or release of it. 10.6 W here Corney & Barrow operates a joint account in the names of two or more Customers, Corney & Barrow shall (unless expressly instructed to the contrary) be entitled to accept, rely upon and act upon instructions given by any one of the Customers named on that account. 10.7 If any provision, or any part of any provision, of these Terms and Conditions shall be or become illegal, invalid or unenforceable in any respect then that provision, or that part, shall be severable from these Terms and Conditions and the remainder of the provision and/or all other provisions shall remain valid and enforceable and the liability of Corney & Barrow and the Customer shall not be affected or impaired. 11.
