General conditions applying to tenancy contract 1) Length of stay : When the dates have been agreed on and the contract signed by both parts – user and owner- the user will have no rights –whatever the circumstances- to stay in the place longer than the date written on the agreement. 2) Formal acceptance of the booking: The booking is definite and firm when the owner has received, before the date indicated page 1 of the contract by the owner, the deposit of 25% of the total amount together with a copy of the first page of the tenancy contract filled in with all the information needed by the owner and signed by the user. No person other than those who have signed the contract can be accommodated except if a written agreement has been reached with the owner. Should this requirement not be respected the booking contract would then be considered as cancelled with wrong against the tenant and the rent would be entirely due to the owner. 3) Cancellation by the user : Cancellation should be notified to the owner by fax or letter. • IF it is before the arrival : The deposit will remain the owner’s right. IF the stay is cancelled late, within the month before the day of the arrival the owner may ask for the payment of the total amount (conditions signed on page 1 of the contract). IF the user gives no notice whatsoever within the day (24 hours) following the first day stated on booking form the latter is automatically cancelled and the owner has a right to consider the flat free for whatever other use he may decide. The deposit remains the owner’s right as well as the balance as notified on contract (ie 75% which should have been paid on arrival). • IF the stay is shortened the total amount will still be entirely due to the owner who will not then have anything to pay back. 4) Cancellation by the owner : The owner will have to pay all the money he has received back to the renter. 5) Arrival : The user should arrive on day and time as notified on contract unless another arrangement has been reached previously (phone or email) to warn the owner. 6) Payment of balance should be paid on arrival. 7) Inventory : Should the user notice something in bad repair or missing he should warn the owner about it on arrival. The cleaning is left to the user during the stay and before leaving. If it is not done at the end of the stay it should be paid in addition as specified on page 1 of the contract. 8) Warrant deposit : On arrival the owner will receive from user a cheque (200 Euros or equivalent in other currency) as a warrant deposit. It will be sent back to the renter within two weeks after the end of the stay, its amount possibly reduced if damages have been stated and must be repaired at the user’s expenses. 9) Extra charges : In case some charges or taxes had not been included in the price they should be paid before leaving. 10) Use : The user will make sure the gîte is used in a normal quiet way and not for any other purpose than intended in the contract, that is holiday leisure. 11) Capacity : The gîte can accommodate a maximum of 5 (five) persons so the owner has a right to prevent the user from using it for more than this number. 12) Animals : This contract establishes that animals –mainly for health reasons- are not allowed. Should this clause not be respected the owner may oppose to the stay. In this case no payment back would be made. 13) Swimming-pool : It is also used by the owner. The tenant is allowed to use this property pool under his own full responsibility. As regard to children security the access to the water has been secured by gates and the adults in charge of the children must make sure they are always properly locked. A booklet in the gîte will give some more information on how to make good use of the pool. Should the swimming-pool be temporarily out-of-order the user has no right to ask for partial or total repayment. 14) Insurance : The user will be held responsible for all kind of damages he may cause. He should make sure he is insured for holiday home renting risks.
