Dear Sir Trade Mark Application No. 1546347 GREUBEL FORSEY & Device in class 14 in the name of GFPI S.A. We refer to your letter dated ER/850 dated 16*^ May 2007, and reply as follows:With regard to the objection raised under Section 9, we would submit that the trademark "GREUBEL FORSEY" consists of the two founders surnames of the applicant company: Robert Greubel and Stephen Forsey, as evidenced in the enclosed photocopy taken on the client's website. The subject mark is already registered in Australia, Singapore and United Kingdom by way of International Trade Mark Registration No.828152 dated 26'^ March 2004. The subject mark is also registered and in force in Germany, Austria, Benelux, China, Egypt, Spain, Federation of Russia, France, Hungary, Italy, Liechtenstein, Monaco, Poland, Portugal Romania, San Marino, Ukraine; Australia,, Denmark, USA, Finland, Greece, Japan, Norway, North Korea, United Kingdom, Singapore, Sweden, Turkey. The copies of the Certificates of registration of the corresponding trademark in the said countries are enclosed. We also enclose photocopy of the assignment Certificate from CompliTime SA to GFPI S.A., and of the official notices of acceptance issued by the Australia, Singapore and United Kingdom Trademarks Offices. Both the surnames 'Greubel' and 'Forsey' are very rare one. The 'Greubel' appears three times in the Swiss Telephone Directory, Greubel Heidi, Greubel Karl Heinz and Greubel Robert and the name Forsey appears one time, according to the enclosed printout of the database. In view of the above the Examiner is respectfully requested to waive the objection. Regarding the objection raised under Section 11 we would submit that in coming to a conclusion of similarity it is the composite mark which should be judged as a whole and not its various dissected elements. The only point of similarity between the cited trademark and the subject one is the two letters 'GF', The rival marks should be compared in their entirety and in which case the subject mark is quite different from the cited trade mark is quite different from the cited trademarks. In the light of the above submission the learned Examiner is most respectfully requested to waive the objection and allow the mark to proceed to acceptance. If the Examiner is not satisfied with our submission, a hearing in the above matter may please be appointed at an early date under advice to us.
