ETF JATMWG comments on the EP amendments voted on 3rd July 2003. Framework regulation Amendment 1 : unacceptable The new definition should comprehend the wording “in keeping with the duty of general interest of air navigation services, including public service obligations.” and “a consistent, high level of safety”. Amendment 3 and 12 : unacceptable The ATM sector does not need any 'Industry Consultation Body'. A proper consultation mechanism should be established by the Single Sky Committee and through social dialogue. Amendments 4 and 15 : unacceptable Legal action can be taken against anyone who breaches law and regulations. There is no need to mention penalties and sanctions. Mentioning them could lead to endangering a provider in a critical situation with possible consequences on its safety chain. Amendments 16 We support it. ANS regulation Amendments 1 and 4: On this issue the EU Commission is drafting a directive on licencing; therefore a new wording should reflect this. Amendments 2 and 8 : We do not think that such short periods (btw 5 and 10 years) are compatible with a serious prospective management and investment programme. National supervisory authorities should be left the initiative of determining the need of such periods. In any case, if such a need was evident, the period should be at least 30 years. Amendment 3 : It should be specified how this reserve will be managed and by whom. We think that an independent body should be in charge. Accordingly this amendment is unacceptable without clarifications. Amendment 9 : Change the wording of 9e. A more secured wording would be : “such conditions shall require adequate investment and staffing as well as technical means to meet requirements of users and overflown population”.

Amendment 10 : There is no need to add such a deadline to a process which must be completed in a reasonable term. We don’t support this amendment. Amendment 15 : unacceptable This amendment is another try to introduce competition between providers. We don’t support this amendment. Airspace regulation Amendment 20 and 22 : Nobody knows to which aspect “single” could be referred to. “more integrated” seems more appropriate. Amendment 21 : We do not know what UNIFORM FBAs could be. Therefore we don’t support this amendment. Amendment 23 : There is no need to add such a deadline to a process which must be completed in a reasonable term. We don’t support this amendment. Amendment 24 and 28 : There is no need to add such a deadline to a process which must be completed in a reasonable term. We don’t support this amendment. Amendment 25 : This is an operational matter which should be not in the “airspace regulation” but technically defined by the Single Sky Committee. Amendment 26 : unacceptable This amendment conflicts with the bottom-up approach strongly requested by the recognized social partners (ETF and CANSO) . Amendment 31 : The need of this study is vital. We don’t support this amendment. Interoperability regulation Amendment 32 : Manufacturers need time to be able to adapt. We don’t support this amendment. 2/2
