TOUCHme technology A touch of magic! The switches and buttons in the housing are completely removed from view and only the user knows the secret mode of operation. Simply touching certain parts of the surface is enough to operate the functions of the housing.

Delivery conditions ¦ In the absence of any other arrangement, production and delivery times are four to six weeks after confirmation of order. ¦ Minimum purchase quantity from the DESIGN EDITION 2006 5 units. ¦ TESTA MOTARI® supplies all models (except notebooks) with a standard, plain ATX housing standardised ATX housing with additional ventilator. Provision of hardware is possible. (See ATX systems design versions) ¦ The price stated for the Notebook design finish refers to the finish and does not include the computer. A design finish is only possible in conjunction with supply of notebook. Various basic devices are available for the adaptation of notebooks. ¦ General Terms and Conditions Testa Motari Designmanufaktur General Terms and Conditions - valid from 1 January 2005 Prices + conditions of payment 1. Prices stated are fixed prices inclusive of VAT. 2. Payment shall be deemed complete when Testa Motari has free access to monies paid. 3. In the event of ordering design models and any samples, the purchase price of such shall fall due upon delivery/collection of the product. 4. In the event of customised productions in accordance with customer wishes, payment in advance in the amount of the purchase price shall be made to the bank account of Testa Motari after confirmation that the order has been received. 5. In the case of deliveries to the purchaser’s address, separate charges for postage/delivery will be made accordingly. 6. Testa Motari reserves the right to alter prices. 7. The purchaser shall be entitled to the right of set-off, retention or deduction, even when defects or counterclaims have been ascertained, only insofar as such counterclaims have been shown to be legally valid or are undisputed. Notwithstanding this, the purchaser shall only be entitled to counterclaims resulting from the same contractual relationship. Object of purchase + reservation of the right of modification 1. Samples are sold in accordance with the illustrations contained within the Testa Motari presentation documentation. 2. All rights are expressly reserved in respect of any production-related deviation of the product from sample illustrations and agreements entered into in respect of colour and structure of natural materials and coverings used which are a result of the manufacturing process. This is without prejudice to contractually assured product features. 3. All design plans produced by Testa Motari or design ideas resulting from a design order shall remain the property of Testa Motari and may not be copied or reproduced, insofar as nothing to the contrary is not expressly agreed. Withdrawal from the contract on the part of Testa Motari 1. Testa Motari shall not be obliged to deliver in the event that components relevant to the production of the product to be delivered are no longer obtainable from the suppliers or in the event of an Act of God, insofar as such circumstances came into being after the conclusion of the contract and Testa Motari is not responsible for the non-delivery and has made endeavours to obtain elsewhere products of the same kind. Testa Motari shall inform the purchaser of such circumstances without delay. Delay in taking delivery 1. In the event that, after expiry of a further deadline granted to him or her, the purchaser refuses to accept delivery or states expressly in advance his or her intention to refuse delivery, Testa Motari may withdraw from the contract or may demand damages in respect of nonfulfilment of contract. 2. Insofar as the delay in delivery is more than one month in duration, the purchaser shall be liable for payment of any storage costs resulting. 3. Testa Motari may avail itself of the services of a freight carrier in respect of storage. 4. As damages in respect of non-fulfilment of contract, Testa Motari may demand up to 50% of the order price, insofar as the purchaser is unable to show that no damage or damage to the extent of this fixed rate has occurred. 5. In the event of customised productions in accordance with customer wishes, Testa Motari may demand 100% of the order price as damages. Taking back of products 1. In the case of a withdrawal from the contract which is the responsibility of the purchaser and in the event of the taking back of products already delivered in respect of this, Testa Motari shall be entitled to refund in full of expenses incurred as a result of contractual services provided, such as transport, planning and production costs. Reservation of title 1. The product shall remain the property of Testa Motari until such time as fulfilment of all obligations arising in respect of the contractual relationship are complete. 2. Testa Motari shall be without delay informed of any change in location and any intervention on the part of third parties, in particular in respect of seizure of goods, in which case the sheriff’s return must also be made available to Testa Motari without delay. Guarantee 1. Guarantee claims are provided in accordance with legal regulations. 2. Liability in respect of contractually assured product features shall be pursuant to legal regulations. 3. Products delivered shall be immediately inspected in respect of completeness and good condition. Damage and other deficiencies discovered shall be declared without delay and proved in an appropriate way. 4. The purchaser is expressly obliged to follow instructions in respect of storage, transport, erection, operation and maintenance. In the event of any deficiencies arising as a result of non-compliance with said instructions, Testa Motari shall not be liable and the purchaser shall be responsible for proof of any obligation to provide a guarantee on the part of Testa Motari. 5. The completeness and good condition of the delivery shall be guaranteed by the signed delivery note or by payment. 6. In the event of defectiveness, only the right to cancel the order shall apply. Further claims in respect of damages are expressly excluded. Place of fulfilment + place of jurisdiction In respect of these General Terms and Conditions and in respect of the legal relationship as a whole between Testa Motari and the purchaser the laws of the Federal Republic of Germany shall apply. Place of jurisdiction is Aue district court and this shall apply in respect of any dispute arising indirectly or directly from this contractual relationship. General Terms and Conditions of the purchaser The General Terms and Conditions of the purchaser are expressly excluded from the contract. Johanngeorgenstadt, 1 January 2005
