Terms and conditions 1. The gîtes at Merlin Gîtes are offered for holiday hire subject to confirmation by Mr & Mrs R Jones (the “Owners”) to the hirer (the “Client”). 2. To make a reservation, the Client should complete and sign the booking form stating preferred dates and return it together with payment of the initial non-refundable deposit (25% of the total hire charge due). On receipt of the booking form and deposit, the owners will send a confirmation invoice/statement. This is the formal acceptance of the booking. 3. The balance of the hire, together with the security deposit (see clause 4) and any other applicable invoice is payable not less than 8 weeks before the start of the hire period. If payment is not received by the due date, the Owners reserve the right to give notice in writing that the reservation is cancelled. The Client will remain liable to pay the balance of the hire unless the Owners are able to re-let the property. In this event, clause 5 of these booking conditions applies. Reservations made within 8 weeks of the start of the rental period require full payment at the time of the booking. 4. A refundable security/damage deposit of £100 (€150) per gîte for the whole hire period required in case of damage/loss to the property or its contents. The sum reserved by this clause shall not limit the Clients’ liability to the Owners. The Owners will account to the Client for the security deposit and reimburse the balance due within 2 weeks of the end of the hire period. If any damage/loss is incurred during the hire period, the hirer will be invoiced accordingly. 5. Subject to clauses 2 & 3 above, any Client cancelling a booking must do so in writing, and the following charges will apply, being calculated from receipt by us of the written cancellation: More than 6 weeks prior to arrival date Loss of deposit 5-6 weeks prior to arrival date 50% of holiday cost 4-5 weeks prior to arrival date 75% of holiday cost Less than 4 weeks prior to arrival date 100% of holiday cost The Client is strongly recommended to arrange a comprehensive travel insurance policy (including cancellation cover) and to have full cover for the Clients vehicle breakdown/recovery, personal belongings and public liability, etc)., since these are not covered by the Owner’s own insurance. 6. The rental period shall commence at 3.30 pm on the first day and finish at 10.00 am on the last day. The Owners shall not be obliged to offer the accommodation before the time stated and the Client shall not be entitled to remain in occupation after the time stated. 7. The maximum number to reside in “Le Chaumine de Morgan” is 5 persons, unless the Owners have given written permission. 8. The Client agrees to be a considerate tenant and to take good care of the property and to leave it in a clean and tidy condition at the end of the rental period. The Owners reserve the right to make a retention from the security deposit to cover additional cleaning costs if the Client leaves the property in an unacceptable condition. The Client also agrees not to act in any way which would cause disturbance to residents in neighbouring properties in the hamlet. 9. The Client shall report without delay any defects in the property or breakdown in the equipment, machinery or appliances in the property or garden/patio area. Arrangements for repair and/or replacement will be made as soon as possible. 10. The Owners shall not be liable to the Client for: a) any temporary defect or stoppage in the supply of public services to the property, nor in respect of any equipment, plant, machinery, or appliance in the property or garden. b) Any loss, damage or injury which is the result of adverse weather conditions, flood, riot, war, strikes or other matters beyond the control of the Owners. c) Any loss, damage or inconvenience caused to or suffered by the Client, if the property shall be destroyed or substantially damaged before the start of the hire period and in any such event the Owners shall, within 14 days notification to the Client, refund to the Client all sums previously paid in respect of the hire period. N.B. Under no circumstances shall the Owners liability to the Client exceed the amount paid to the Owner for the hire period.
